Woman sentenced for heroin dealing

WHITE RIVER JUNCTION — A White River Junction woman will spend up to five years in prison for dealing heroin.

Barbra J. Robare, 22, pleaded guilty Tuesday in White River Junction District Court to felony charges of possession and distribution of heroin. The charges carry a combined maximum penalty of 30 years in prison, but Robare received a sentence of six months to five years.

According to an affidavit filed with the court, the evening of Dec. 13, Hartford Police received a report of a large amount of heroin being sold from the Sykes Mountain Avenue residence of Kerri McCarthy, 21. Records state James Carter, 28, and a woman who wished to remain anonymous told police they had been in McCarthy's residence earlier that day and had seen between two and four bundles of heroin there. Each bundle contains 10 bags and each bag contains about 30 milligrams of heroin, records state.

Carter reportedly told police that for the past few months he had been buying between 40 and 50 bags of heroin a week from McCarthy and Robare, records state. Carter told police the heroin was for personal use and he wanted to get clean, according to affidavits.

Police knew McCarthy was on probation and one of the conditions of her probation was a warrantless search of her residence, records state, and police, probation and a police dog from Lebanon, N.H., soon descended upon McCarthy's residence.

A search of the residence revealed 341 bags of heroin, weighing a little more than 10 grams without the packaging, records state. Police also found cash and needles, which they seized along with the heroin.

Robare reportedly told police all of the drugs belonged to her.

Robare's guilty plea follows an earlier guilty plea by McCarthy, both of whom are serving time in Northwest State Correctional Facility in Swanton, according to the Department of Corrections.

This woman shouldn't spend one day in jail. heroin should be legal. Portugal decriminalized all drugs in 2001 and their experience has been positive. Now if you are caught with a 10 day supply of your drug or less you face an administrative court, not a criminal court. We can do that here in the USA. A group of 10,000 very serious policemen, prosecutors, attorneys and citizens have formed a group to legalize ALL drugs, Law Enforcement Against Prohibition (http://leap.cc ) They see what happened when we legalized alcohol in 1932 as a good example of how drug legalization would work. We can't stop drugs. They're sick of chasing drug users and sending innocent people to prison for decades just because they like to get high. This foolish war on drugs has lasted 37 years and cost us over a TRILLION dollars and we are not an inch closer to stopping drugs. How many millions of Americans are we going to lock up in prison for decades? Legalize ALL drugs now. Mark Montgomery boboberg@nyc.rr.com
