Rutland Police officer, woman injured in head-on collision -- 3:15 p.m.



A woman on a stretcher is taken from the scene of a collision with a Rutland City Police cruiser this afternoon in downtown Rutland. The police officer was transported by another ambulance moments earlier.

A Rutland police officer and a woman were taken to the hospital following a head-on collision on West Street this afternoon.

Shortly after 2 p.m., police and emergency medical teams were called to the heart of the downtown where the crash took place in front of 138 West St. near the post office.

Officer Gary Tobin, 52, was transported to Rutland Regional Medical Center following the wreck, according to police and other city officials at the scene.

Tobin's condition wasn't immediately available, but police and city Public Works employees who helped remove him from his cruiser said the officer looked pale, was unconscious and in poor condition.

Police said he regained consciousness en route to the hospital and was reported to be alert.

His cruiser, which was traveling west, was situated in the east bound lane after the impact -- its front end compressed against a black Mercedes.

A woman, who was not immediately identified, was driving the Mercedes and was also taken to RRMC.

She was conscious and alert as rescue workers loaded her into an ambulance.


The accident is being investigated by Vermont State Police who did not comment at the scene.

One witness, who works at the nearby Citizens Bank, said she saw the cruiser accelerate and cross into the oncoming lane before the crash.

So I found this article in yesterday's paper:

"A Rutland Police officer injured in an automobile accident Thursday is out of the hospital, according to city police.

But the reason for an apparent seizure that caused Officer Gary Tobin to veer into a stopped car on West Street is still unclear, city police Lt. Kevin Geno said Monday.

Tobin told State Police investigators he has no recollection of the accident or events leading up to the crash that sent the 52-year-old officer and Proctor resident Mary Smith, 78, to the hospital.

Witnesses at the scene told police it appeared Tobin was having a seizure in the moments preceding the head-on collision between the cruiser and the Mercedes 300 that Smith was driving.

Geno said medical staff at the hospital had already performed a number of tests on Tobin and had scheduled several more. Geno also said Tobin has not returned to work yet and did not know when he would return."

In other words... the hospital found nothing.

Gosh... who's surprised?

So here we are, a week after the incident, and... any more information on Officer Crashy McAirBag and his mysteriously appreaing driving malady?

Or should we all use the same line whenever we pull a boneheaded and potentially fatal driving manuever -- claim that we feel icky and blame a previously-unknown medical condition?

Officer: Hey, pal, why'd you suddenly accelerate across two lanes of wrong-way traffic and crash into a school full of nuns?

That Guy: Ooohh... uuhhh... I, uh, feel bad. Like I'm about to, uh, swoon. (He swoons.)

Of COURSE Tobin was pale and unresponsive! He just speared another car in the wrong lane in the middle of downtown!

In related news, Officer Ed "'70s Stache" Dumas would like to thank Tobin for making the public forget about his lawsuit for a while.

Lately, I've seen an amazing thing. Police cruisers on the streets of Rutland in the Downtown area. I'm thrilled and delighted that our men and women in blue are actually on the streets, unfortunately I have come to realize this is a short term phenomenon while the police union is negotiating new terms with City Hall and we will soon return to the phatom streets of Rutland overrun with scum when the ink is dry. What a way to run a city. To get to the topic, perhaps this officer needed a refresher course in driving, since police cruisers patrolling or at least crusing the streets are a rare cite if not, against union demands. Like walking the beat, and looking at the gurth of some of our professional employees. The exertion of a few steps forward would cause blood pressures to rise and the heart to go aflitter. Isn't there a physical fitness requirement in order to stay on the force. There's one guy, we must have to have a special car unit just to fit him. he's enormous, morbidly, how can he perform any duties? and how many of our firemen are certified for the latter truck, 2!

I find, that most people who complain about the police are the ones who have the most run-ins with them. I also think that people talk alot of **** on these posts and act like johhny tough-nuts, but when it comes down to it, they wouldn't be able to say anything of this stuff to peoples' faces.

Life happens, accidents happen, if he made a mistake then he made a mistake. He's human, just like everyone else.

People have these unrealistic excpectations of civil servants. We can't be infailable. We're not robots, we make mistakes. We try very hard to be professional to everyone. But the minute we make a mistake, every Tom, Dick and Harry want to see us swinging from a tree. relax, and by the way, if you think you could do a better job, feel free to work for me for a day and see how long you last before you ***** something up.

i want to thank cf reality for agreeing with me on the part of having to defend myself against smart thinking, i feel he is out of line with that kind of comment towards my fmaily and i have done a report on him, and as far as notta bushman i hate to tell you there buddy but we are not the same person i would never leave a comment like smart thinking did and i have a life other then leaving comments on the rutland herald site, i work and go to school full time unlike most people that post comments on this site and futhur more anything that comes out of my mouth is not nasty and dirty like smart thinking who probably has nothing better to do then to run people and their families down so all i have to say to you is that if you have nothing beeter to do then to run people down on this site then keep your mouth shut and your lowlife comments to yourself as well

Michele, in Rutland, it would not be a surprise to anyone that his medical condition (seizures) was buried deep in the caverns, reason for school yard duty somewhat similar to the ferry accident in NY harbor from Statin Island. Non reported medical condition the factor in many lost of lives. In Vermont there seems to be even less concern for the public at large, therefore even less scrutiny. Don't you have some cages to rattle, up there. Some convicts to hassle or something while your on the job.

first of all i work hard everyday for my money and i have never had a drink nor have i ever done drugs nor will i ever and my family wreath is just fine unlike yours, you make a comment about making more babies with my sibilings are you just telling us all that because that is what you have done with your family because it sure sounds it to me, i am not from danby and i have a really good family life and trust me their buddy my family has alot of ties to people here in rutland city and maybe i do know a little more from the inside then you people do but i guess that you will never know now will ya !! i agree with everyone that states IT CAN HAPPEN but at the sametime when you know about a health issue and you do not do anything about it and you get behind a cruiser and drive and put other people in harms way or in danger how is that fair or right to the citizens of rutland and surronding areas. i am truely sorry about both parties who were involved in this so called accident ( that could of been prevented). i never once said anything towards any other person that has posted on here other then saying that michelle would stick up for the rpd and that the rpd is not the best at what they do for work and that is rightly my opinion. and just to let everyone know i did graduate from high school and have a college degree unlike most of these thugs that post on this site. i also think that getting into my family is very personal and i would never make a comment about someone's family and the way that they live their lives like smart thinking has done towards my family, everyone is so eager to jump on me about speaking my opionion and say how ignorant i am and so on but yet this fool you call smart thinking can slander a person and be inconsiderate towards someone's family and noone has anything to say about that now if you sk me that is just a little out of line and i also have the right to report a comment which i have done so already, i hope that smart thinking is never able to post another comment on this site ever again and for everyone else say as you please like i have said and will continue to say i have a right to my opionion and i will say as i please !!!

just to let you know many schools change school resource officers and it doesn't mean anything. I honestly don't think that IF Officer Tobin does have a medical condition, that he knew about it prior, he would not put peoples lives in danger. Most medical conditions are treatable and it doesn't mean IF he does have one, he would have to give his job up.

Fortunately, as serious as this car incident was, no one seems to be critically injured or death resulting. But it does seem odd that an officer formerly assigned as a school hall monitor, once returned to an active post, seems to have suffered some kind of medical condition, by simply driving the patrol car. If it is as I fear, a medical condition that could prevent an employee from fully performing his duties and not reported, I see another lawsuit waiting up the road, especially if they did know but put him on the road anyways.

The way I see it, is this.

Brent Curtis posted a very provocative "eye-witness" tale. And I'm glad most people see through it. And the majority, that are posting here, are looking for "more truth" before coming to any conclusion. I just hope they do the same for "all people". Cops, afterall, are people.

Now the article.....

Yes, he may have accelerated and went into oncoming traffic. We know he went into oncoming traffic. It's visible in the photograph. The real question is, Why?

A) Health Issue?
B) Avoiding a child/pedestrian?
C) Avoiding one accident and getting into another?
D) Quickly responding to a call?
E) Accident-Trying to pass without an emergency?

Hopefully, he wasn't avoiding a car in his lane. Always best to avoid oncoming traffic. Rearending someone may end up in silly, unprovable whiplash, everyday lawsuits but it's better than hitting someone head on.

I agree with everyone else. A medical condition seems logical. Many conditions could cause someone to tense up, accelerate, and lose control of a vehicle. I can't imagine someone swerving and accelerating to avoid a pedestrian. Doesn't make sense to me. Is this eyewitness credible? Not even a name given?

You must realize. One day you could be running miles and feeling good. The very next day you could be on your death bed. Things happen within the human body much like "mother nature". Sometimes doctors can prevent stuff by seeing noticeable signs. Other times, it's like a freak storm out of no where. Even Michael Jackson had a physical done, by a team of doctors, before the promoting company would sign on. This error may cost them 40 million or more. Accidents happen. **** happens. It's life.

One can not assume that Officer Tobin had a history he was aware of...unless you have inside family information you are not sharing. You do have freedom of speech --- you also have the right as a human to respect other humans as individuals. Woe be the day you wake up fine, then unexpectedly black out and crash into my car. My father woke one November morning feeling fit and happy. By noon that day he had died of a heart attack in his recliner. Sometimes "it" just happens. Please try to consider that possibility.

Listen up dum 2, nobody is a fortune teller. its impossible to know when you get up in the morning and you start your day that you will probably have a health issue. if that were the case lots of folks would be alive right now because they would have known that they were gonna have a heart attack and they would have driven them selves to the hospital before they had it. I have been in emergency services for over 17 years and seen a lot of accidents that were caused by medical emergencies. it happens. this law enforcment officer didnt expect this to happen. so cut the guy a break will ya. as for Mrs Smith and officer Tobin get well soon and I am glad that both of you are ok. as for dum 2 I see where you are going with this. and you need to stop monday night quarter backing. these folks are dealing with real issues here and some respect is in order.

i have read plenty of your comments that are nothing but gibberish **** as well so maybe you should practice what you preech their buddy and for the rest of you all maybe it was a health issue and thats why this happened but even so maybe if he had health issues he should not be behind a wheel of a car and michelle you say what "IF" it was a child that ran out in front of him well if it was a child that ran out in front of him that child sure would not be here with us today all because a police officer has health issues and cannot control the cruiser he is driving what about that!! yeah everyone has health issues the problem is that if he has health issues and knows that this stuff can or could happen then he should not be driving a car period, my father in law has health issues and they took his driver's license away for 6 months because it could be possible that he have a siezure while driving and so they should do the same with officer tobin it should not matter if he is a police officer or not espicially when other citizens are at risk with him driving on the streets of rutland. what if he was involved in a highspeed chase while this happened not only his life would be in danger but alot of innocent citizens would of been too !! it is too bad that this did happen but at the same time if he has helth issues that prevent him from doing his job then maybe he should not be on the force STOP AND THINK about that. michelle i think that you really need to get a life your on here saying how wonderful our police are and all this bogus bull well if that was the case then we would not have issues with the criminal s*** that we do now like drugs and guns and killings etc.. you may think that you are all that because your are with a police officer but i hate to tell you there sweetheart you need to get a grip on reality. it is really too bad then anyone got hurt and my condolences go out to the families but i also do not want a officer driving on our streets that could put other citizens in harms way noone seems to think about that and as for anyone else i will post my comments as i feel fit this is a free country and thts why we have the freedom of speech.

Thanks everyone. It seems people are so quick to judge. I mean 2 people are in the hospital. And the first thing I read is "oh this cop doesnt know how to do his job." What if he did have something serious happen to him. Its your place to say Get him outta here. No. If he did have a medical problem Im sure he will be treated for it. As for any of you have you not been texting and then looked up to see youre halfway in the middle of the lane or been looking for something on the floor and end up slamming your brakes cuz there is a red light up ahead. Stopping judging other people for their faults we are all human and make mistakes! Thank you for the people you are generally concerned for my Uncle. And I pray for you also.

Sorry to hear about both parties. I hope all will be well with both.

MY question is: Has RPD learned anything (Public Relations wise) in the past few months?

Will the Chief have an outside Agency (VSP) look into the events that caused this?

Will RPD release the video of the impact as they did in the Kevin Coleman case?

It will be interesting to see how this plays out now that the RPD is the issue and not
the motoring public.

Hey dum dum - I also have been involved in emergency services and you should not jump to conclusions. Have you ever felt dizzy, had a syncopal episode? Do you even know what that means? It appears that no one was seriously hurt and that is important. I am sure the cause of the accident will be investigated. Meanwhile you should stop jumping to conclusions. Also, until you are involved in emergency services, whether paid or preferably as a volunteer, keep your thoughts to yourself.

Get a new hobby, cause bashing the police is really getting old. As for Officer Tobin, and the other victim in this MVI I hope you get better.

so what are they saying it is is fault then because if so then clearly we do not have very good drivers for our finest police now do we and at 52 i would retire because clearly you are not able to do your job to the fulliest as other young police can but i hope the other driver of the mercedes goes after our police and make them pay like they do everyone else
