Speed stop yields drunken driving rap

WHITE RIVER JUNCTION — A Windsor man's need for speed has him facing his third drunken driving charge.
Tuesday, Matthew C. Fotion, 36, pleaded innocent in White River Junction District Court to a felony charge of drunken driving, which carries a maximum penalty of five years in prison and a $2,500 fine.
Fotion has two prior drunken driving convictions in 1997 and 1998, both in Middlebury District Court.
According to an affidavit filed with the court, around 6:30 p.m., a police officer clocked Fotion riding 69 mph on a Harley Davidson Sportster while traveling south on Route 12 in Hartland. Fotion reportedly told police he had consumed one rum and Coke, but a breath test revealed he had a blood alcohol count of 0.127, records state. The legal driving limit in Vermont is 0.08.
Fotion is free on conditions he not drink and submit to alcohol testing upon the request of any law enforcement officer.
