Man faces child porn charge

WHITE RIVER JUNCTION — A Windsor man is behind bars on charges he viewed child pornography.
Carleton G. Murphy III, 22, pleaded innocent Tuesday in White River Junction District Court to misdemeanor charges of possession of child pornography and resisting arrest, which carry a combined maximum penalty of three years in prison and $5,500 in fines.
According to an affidavit filed with the court by Windsor police Sgt. Linda Shedd on Monday afternoon, Windsor police received a call from the Department for Children and Families stating they had received a complaint of Murphy looking at child pornography on his girlfriend's parents' computer.
Police went to the residence and observed images on the family computer that appeared to be of young girls in sexually suggestive poses, affidavits state. Police interviewed residents of the home, who said that based upon the computer's browser history, Murphy was the only person in the house at the time the images were accessed, records state.
As Shedd was placing the computer in her cruiser as evidence, Murphy approached her, stating he was tired of being called a pedophile and wished to speak with her, records state. Murphy went to the Windsor Police Department and told police he did not look at any child pornography on the computer, but did admit showing images of his cousin who works as a stripper to members of his girlfriend's family, according to affidavits.
Following the interview, Shedd told Murphy he was under arrest, but Murphy — who stands 6 feet tall and weighs 260 pounds — refused to be handcuffed and the two began to struggle, records state. Shedd attempted to use her pepper spray on Murphy but the results were not what she intended.
"At this time, due to Murphy continuing to resist arrest, I sprayed pepper spray in Murphy's face, which deflected off him and back into my own face, causing me to lose my vision," Shedd wrote.
Murphy fled the police station but was later captured without incident, affidavits state. During Murphy's arraignment, Windsor County State's Attorney Robert Sand pointed to Murphy's alleged escape, as well a prior failure to appear in court for arraignment, as indications that Murphy was a flight risk.
Judge Theresa S. DiMauro set Murphy's bail at $10,000, but also ordered him held without bail for allegedly violating his probation, his third probation violation complaint. In 2008, Murphy was placed on probation for misdemeanor domestic assault, records state.
Murphy is being held in Springfield prison.
