BENNINGTON — An Arlington man is facing a felony charge of driving under the influence of alcohol after police said he was stopped Monday in Manchester with a blood alcohol content almost double the legal limit.

William J. Whitman, 46, of Arlington, was arraigned Tuesday in Bennington criminal court on two felony charges of driving under the influence of alcohol, one related to driving while under the influence and the other related to driving while over the legal limit. Whitman pleaded innocent to the charges and was released without bail.

In an affidavit, officer Abigail Zimmer, of the Manchester Police Department, said she noticed Whitman driving about 7:45 p.m. Monday around on East Manchester Road near Hillcrest Road. Zimmer said Whitman’s vehicle was crossing over the center line of the road.

According to the affidavit, Zimmer followed Whitman but another truck came between Whitman and the police cruiser. However, Officer Christopher Mason, also of the Manchester Police Department, stopped Whitman for a speeding violation on Richville Road.

Police said Whitman’s blood alcohol content was measured at 0.159 percent at about 8 p.m. The legal limit in Vermont is 0.08 percent.

A second test conducted at the Manchester Police Station around 11:10 p.m. showed a blood alcohol content of 0.154 percent, Zimmer said.

Court records indicated that Whitman was previously convicted of driving under the influence of alcohol in April 1981 and July 2011.
