Kidnap attempt conviction voided
MONTPELIER — The Vermont Supreme Court has overturned the conviction of a Swanton man who was sentenced to serve 30 years to life for the attempted abduction of a woman in Burlington.
The justices ordered Chittenden County Superior Court to look again at the case of Harold D. Porter, who was 45 when he was convicted in 2012 in the incident three years earlier.
The Burlington Free Press reports the Supreme Court faulted Judge James Crucitti for allowing police to testify about how they eliminated from suspicion some potential suspects who drove trucks closely matching Porter’s.
The defense had objected during Porter’s trial that only 12 of the 20 owners of Vermont-registered trucks similar to Porter’s were called to testify.
