BECKETT OCCUPANTS OF: 70 West Street, Proctor VT MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered August 10, 2018, in the above captioned action brought to foreclose that certain mortgage given by Christopher P. Beckett to Mortgage Electronic Registration Systems, Inc., as nominee for People's United Bank, dated April 29, 2011 and recorded in Book 84 Page 388 of the land records of the Town of Proctor, of which mortgage the Plaintiff is the present holder by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for People's United Bank to Bank of America, N.A. dated January 18, 2017 and recorded in Book 106 Page 190 of the land records of the Town of Proctor, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 70 West Street, Proctor, Vermont on May 30, 2019 at 9:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises conveyed to Christopher P. Beckett by Greig A. Costantino Antiques, Inc. by Limited Warranty Deed dated April 29, 2011, to be recorded in the Proctor Land Records, and more particularly described in said Deed as follows: Being all and the same lands and premises conveyed to Greig A. Costantino Antiques, Inc. by Limited Warranty Deed of Vermont Housing Finance Agency dated June 14, 2010 and recorded on July 20, 2010 in Book 82 at Page 169 of the Town of Proctor Land Records and which lands and premises are more particularly described in Schedule A which is attached hereto and made a part hereof. Being all and the same lands and premises acquired by the Vermont Housing Finance Agency pursuant to a Judgment Order and Decree of Foreclosure in the matter of Vermont Housing Finance Agency v. Scott R. Merrill, Pamela A. Merrill and CitiFinancial, Inc., Rutland Superior Court Docket No. 686-9-09 Rdcv, dated March 24, 2010, and the Certificate of Non-Redemption and Certified Copy and Writ of Possession, dated May 27, 201 0 and recorded in the Town of Proctor Land Records at Volume 81, Page 316. The premises conveyed herein are more particularly set forth on Schedule A, attached hereto and made a part hereof. Being all and the same lands and premises conveyed to Scott R. Merrill by Warranty Deed of Katherine A. Nesshoever and Ralph W. Merrill dated April 7, 1997 to be recorded in the Town of Proctor Land Records and therein described as follows: Being all and the same lands and premises conveyed to Katherine A. Merrill and Ralph W. Merrill by Quit Claim Deed of Katherine A. Merrill, dated November 28, 1990 and recorded December 5, 1990 in the Town of Proctor Land Records in Book 28 at Page 452 and more particularly described as follows: Being all and the same lands and premises conveyed to Katherine Merrill, the Grantor herein, by Warranty Deed of Christine Briggs dated October 3, 1989 and recorded in the Land Records of the Town of Proctor in Book 27 at Page 428 and therein descried as follows: Being all and the same lands and premises conveyed to Christine Briggs and the late Robert R. Briggs by Warranty Deed of Anna Greene, dated April 2, 1946 and recorded at Book 7, Page 1029 of the Proctor Land Records, and more particularly described as follows: Being all and the same lands and premises conveyed to David Greene and Anna Greene, husband and wide, by Margaret Dwyer and John Dwyer, husband and wide, by deed dated July 28, 1927 and in the deed described as follows: The Dennis Lyons place, so-called, located on the easterly side of West Street in the village of Proctor, being all and the same premises describes by the Honorable Probate Court within and for the district of Rutland to the said Margaret Dwyer by decree dated June 16, 1927, recorded in Book 5, Page 493 of the land records of said Town of Proctor, and being all and the same premises conveyed to Dennis Lyons by Rollin C. Mead, Administrator of the Estate of Rawson S. Humphrey, late of Proctor, deceased, by administrator’s deed dated March 17, 1884, recorded in Book 44, Page 378 of the Land Records of the Old Town of Rutland, to which decree and deeds and the records thereof reference is hereby had for a more particular description, and subject to all the reservations and conditions in said deeds contained. Reference is hereby made to said deed from Margaret Dwyer and John Dwyer and the record thereof in Proctor Land Records in Book 5 at Page 496, for a more particular description. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
