MORGAN OCCUPANTS OF: 12 Watkins Avenue, Rutland VT MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered October 19, 2018, in the above captioned action brought to foreclose that certain mortgage given by Barbara Morgan and Donald Morgan to Mortgage Electronic Registration Systems, Inc., as nominee for Franklin American Mortgage Company, dated April 17, 2006 and recorded in Book 551 Page 684 of the land records of the City of Rutland, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for Franklin American Mortgage Company to Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing, LP dated November 1, 2011 and recorded in Book 606 Page 340 of the land records of the City of Rutland for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12 Watkins Avenue, Rutland, Vermont on May 28, 2019 at 9:00 AM all and singular the premises described in said mortgage, To wit: A certain piece or land in Rutland, in the County of Rutland, and Slate of Vermont, described as follows, viz: Parcel #1 Being all and the same land and premises conveyed to Walter B. Brown and Mary H. Brown, husband and wife, by Lloyd M. Hier, by quitclaim deed dated the 7th day of August, 1957 and recorded in the land records of the City of Rutland in book 94 at page 433, and therein described as follows: "Being the premises known as No. 12 Watkins Avenue in said City of Rutland and being all and the same lands and premises conveyed to Lloyd M. Hier by deed of Walter E. Brown and wife, dared August 7, 1957 to be recorded in Rutland City Land Records and in said deed described as follows: Being the premises known as No. 12 Watkins Avenue in said City of Rutland and being all and the same lands and premises conveyed to Walter E. Brown by deed of George J. Brown dated February 1, 1949 and recorded in Rutland City Land Records in Book 85 at page 466 and bounded and described as follows; "Beginning in the east line of Watkins Avenue, so-called, at the southwest corner of a strip of land now owned by Patrick Crowley, and running thence southerly along the east line of Watkins Avenue One hundred feet (100) to land supposed to be now owned by N. Bradley; thence easterly about seventy five feet (75') along the north line of said land of said Bradley to land supposed to be owned by Bradley; thence northerly one hundred feet (100’); and thence westerly about seventy five feet (75') to the place of beginning. This deed is made subject to the same conditions and restriction as to the building specified and set forth in a deed from Sarah M. Wrangham to Austin A. Mill." Parcel #2 Being all and the same lands and premises conveyed to Walter Brown and Mary Brown, husband and wife, by deed of Patrick F. Crowley, a single person, by deed dated the 19th day of July, 1958 and recorded in the land records of the City of Rutland in book 108 at page 111, and therein described as follows: "Being at an iron pipe driven in the ground three (3) feet North 11˚ 30' East from the northeast corner of lands presently owned by the Grantees herein Walter Brown and Mary Brown, and thence running South 80° East thirty-eight (38) feet to another iron pipe; thence running South 11˚ 30' West ninety-six and four tenths (96.4) feet to an iron pipe, which pipe is twelve (12) feet northerly from an old cellar hole thence running North 80° West thirty-eight (38) feet to a point in the easterly line of lands presently owned by the Grantees herein; and thence running North 11° 30' East about ninety-six and four-tenths (96.4) feet to the point and place of beginning. Being a portion of those lands conveyed by and described in the deed from James E. Scully to the Grantor herein, Patrick F. Crowley, dated December 3, 1938 and recorded in the City of Rutland Land Records in Book 63 at page 474." The said J. Fred Carbine, Jr. in conveying the aforesaid premises in acting under power of attorney given by Patricia E. Jones, widow, by power of Attorney dated July 7, 1970, to be recorded In the Land Records of the City of Rutland, to which Power of Attorney reference is made and had when recorded in the Land Records of the City of Rutland. Parcel No. 13-7956 Address 12 Watkins Avenue, Rutland, VT 051 Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
