In accordance with the Judgment Order and Decree of Foreclosure entered December 17, 2018, in the above captioned action brought to foreclose that certain mortgage given by Michele M. Hebert to Mortgage Electronic Registration Systems, Inc., as nominee for PHH Mortgage Corporation, dated November 23, 2009 and recorded in Book M-3 Page 116 of the land records of the Town of Londonderry, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for PHH Mortgage Corporation to Nationstar Mortgage LLC d/b/a Mr. Cooper dated December 20, 2017 and recorded in Book 81 Page 118 of the land records of the Town of Londonderry for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 14 Roberts Road, Londonderry, Vermont on May 23, 2019 at 11:30 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises conveyed to William T. West by Warranty Deed of Steven Dorso and Eileen F. Dorso dated December 21, 2001 and recorded December 26, 2001 in Book 58 at Page 503 of the Town of Londonberry Land Records. Said lands and premises are more particularly described as follows: Being all and the same lands and premises as conveyed to Steven Dorso and Eileen F. Dorso by Warranty Deed of Erik B. Siborg, Jr. and Mary C. Siborg dated September 19, 1997 and recorded September 23, 1997 in Book 54, Page 585 of the Land Records of Londonderry, Vermont. The premises are therein described as follows: "Being all and the same lands and premises as were conveyed to Erik B. Siborg, Jr. and Mary C. Siborg by warranty deed of Richard Siborg dated July 7, 1981 and recorded July 9, 1981 at Book 40, Page 19 of the Land Records of Londonderry, Vermont and being also all and the same lands and premises as were conveyed to Erik B. Siborg, Jr. and Mary C. Siborg by corrective and confirming deed of Richard Siborg dated August 8, 1997 and to be recorded contemporaneously herewith and immediately precedent hereto in the Land Records of Londonderry, Vermont, and in said latter deed described as follows: Being all and the same lands and premises as were conveyed to Richard Siborg and Erik Siborg by warranty deed of Ellsworth B. Barker, joined by his spouse, Lillian M. Barker dated November 21, 1957 and recorded November 23, 1957 at Book 27, Page 413 of the Land Records of Londonderry, Vermont; and being also all and the same lands and premises conveyed to Richard Siborg by Erik Siborg by Quit Claim Deed dated August 2, 1976 and recorded October 1, 1976 in Book 35 at Page 316 of the Londonderry Land Records, more particularly described as follows: Beginning at an iron pipe found in a stone wall located in the southerly right of edge of Town Road No. 68, so-called; thence running South a distance of 278.37 feet along a barbed wire fence and lands now or formerly of Robert W. and Sarah L. Hazelton to an iron pipe found; thence turning and running along lands now or formerly of George P. and Angela R. Bosnak, North 53˚ 51’ West a distance of 118.30 feet, more or less to a 3/4" iron pipe; thence turning and running North 14˚ 46' West a distance of 131.32 feet, more or less to a point said point being located at the intersection of two stone walls where Town Road No. 9 and Town Road No. 68 intersect; thence turning and running along a stone wall North 65˚ 44' East a distance of 61.52 feet, more or less, to a point; thence continuing along said stone wall North 68˚ 01' East a distance of 136.48 feet, more or less, to a found iron pipe which pipe marks the point and place of beginning. Said parcel estimated to contain 0.64 acres, more or less. For a more particular description, reference may be had to a survey entitled "Property of Richard Siborg, Landonderry, Vermont", prepared by Dauehy Associates, Inc., Jamaica, Vermont”, drawing number 80-1183, dated May 13, 1981." Also meaning and intending to convey any and all of the right, title and interest of Steven Dorso and Eileen F. Dorso in and to those lands lying within the public right of way of Barker Road as the same borders upon the premises herein conveyed. This conveyance is subject to such rights of way, water and pipe line rights, utility and other easements as may exist of record upon the premises. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
